NGER & Related Legislation Does our organisation need to register and report?

The thresholds for businesses required to register and report has recently been lowered. Currently a Corporation that produces or emits 87.5kt of CO2e, or consumes (or produces) 350Tj of energy. The threshold for facilities is unchanged - 25kt of CO2e emissions or 100Tj of energy produced or consumed.

If you are unsure of your registration or reporting obligations then you need to visit www.dlimatechange.gov.au for further information.

How do we determine who has operational control?

Operational control is determined by the guideline of whomever (eg whichever corporation) has the power to implement OH & S or environmental policy at a particular site. For further clarification please refer to Pg20 of the NGER Reporting Guidelines.

What do we need to report?

The range of data that needs to be collected could be as simple as a single source of a single type of fuel, or could be as diverse as needing to clarify all of the following for fuel alone - even before you consider other types of emissions generated by your business - eg;

    a) Which state was the fuel purchased in?
    b) What type of fuel is being purchased? (eg LPG, Diesel, Unleaded Petrol, Oxyacetelene, Coal)
    c) Is it used for Transport energy or stationary energy? (ie a non read registered vehicle or generator)
    d) If transport fuel is it being used in a Euro I, Euro III or Euro IV compliant engine?

Identifying emissions sources within your business is not a service provided by Ndevr.

If you are unsure of your businesses emissions sources then a good place to begin the identification process is to review your invoices. You may also need to consider utilising additional external resources to assist with this process.

International Reporting Schemes Our company exports to the EU - what environmental legislation should we be considering?

There are environmental regulations that apply across the EU, and regulations that are unique to member countries within the EU as well. In most cases the Australian corporation will not be obliged to provide data directly, but rather the EU based counterparty is required to report, and as such requires the data relating to manufacture and transport of goods from the Australian company.

Some of the schemes in the EU that your counterparty may be operating within the constraints of or reporting to are

United Kingdom - CRC (Carbon Reduction Challenge)
France - Bilan Carbone
Germany - National Sustainability Strategy

If you are an Australian corporation trading in the EU you may be asked to report - directly or indirectly, and your emissions management software needs to be capable of generating the relevant reports at a standard that is consistent with international regulations - Managing emissions through your ERP software is the only way to achieve this level of compliance.

Our company exports to the USA - what environmental legislation should we be considering?

As with corporations exporting and trading in the EU - corporations exporting and trading in the US need to consider their reporting obligations with their counterparty's environmental policies and with relevant state based legislation.

The US is currently drafting a nationwide reporting framework via the Environmental Protection Agency (Federal Body)

Our company is the subsidiary of an EU based corporation - do we still need to report under NGER?

If your organisation meets or exceeds the NGER reporting thresholds then you are obliged to report under the Act back to the Department of Climate Change - It may also be the case that the EU based parent company requires reports from the Australian based operations to roll up into their own environmental reports.
